Sometimes you have to file a suit just to get the insurance companies and defendants to pay attention to the case. Sometimes a case is resolved before suit because of the extent of the injury. Maybe it’s a limited insurance policy, and it’s a significant injury, and the insurance carrier tenures the policy and there’s nowhere else to go to get more funds to you. It’s not an easy answer, but you can resolve the case prior to suit. You may find yourself having to take less than you may otherwise take if you put a case into litigation. In order put the greatest amount of pressure on the insurance carrier, we often take the position that the best way to do that is to put the case into litigation, but it doesn’t mean that it can’t be settled before it goes to trial.
