Question:

Do I have a personal injury case?

Answer:

You may be wondering whether or not you have a personal injury case in the state of New York. There are a number of factors you need to look at. One of the factors is whether or not you have an injury. In order to have a claim, you need an injury. That might include a fractured leg or a broken arm, internal injuries, soft tissue type injures, a neck or back injury, torn knee, or shoulder. These are the types of injuries that may justify a claim, but having an injury isn’t enough. You have to have someone to blame for that injury. You have to show that some individual or entity was careless and negligent.

A good example of that is maybe you tripped on a sidewalk because the sidewalk was raised a little bit, and the property owner adjacent to that sidewalk did nothing to repair that sidewalk, so you would have a claim against the property owner, but possibly a claim against the city of New York or some other municipal entity as well, depending on where that defect was located. These are the things you need to look at to determine whether or not you have a personal injury claim.
