Partial Fault Truck Accident We very often get the question, “I was in an accident with a truck, and I was partially at fault. Do I still have a claim?” The answer is yes. Of course, that will depend on exactly what happened, but the answer is, yes. Very often when we have a new client who calls to tell us that they were partially at fault and we ask them to explain exactly what happened, we come to learn that most of the fault, if not all of it, was the other driver.

Here’s a simple example: We had a client who called to say that she had stopped short to make a left turn, and she was struck in the rear by a truck. She thought it was her fault because she had stopped short to make the left turn, but our answer to her was, “No, you made that left turn there. The operator of the truck has an obligation to see what’s going on in front of them.” As operators of motor vehicles, we all have an obligation to see what’s going on in front of us. The majority of the fault, if not all of the fault, was on the part of the truck operator.
